EXPORT, Pa. — The Westmoreland County District Attorney’s Office announced Thursday that it will not pursue criminal charges in a deadly shooting that stemmed from an argument over a parking spot over the summer.

Daniel Chicka, 65, was shot and killed on June 18, 2024, on Madison Avenue. Since then, the DA’s office said the police investigation was reviewed by a team of prosecutors, including District Attorney Nicole Ziccarelli.

Video evidence shows a verbal fight between Chicka and neighbor Matthew Miller. Moments later, the DA’s office said Chicka can be seen pulling out a gun and pointing it toward Miller before Miller fired several rounds from his own gun.

A release from the DA’s office said that it “recognizes the legal right of individuals to protect themselves and others from imminent serious bodily injury.”

“I am profoundly sorry for Mr. Chicka’s family’s loss; however, I am committed to resolving cases based upon the facts and the law,” Ziccarelli said.

Criminal charges for narcotics-related offenses against Miller are pending.
