Attorney for wife of man killed in crash involving DUI plans to sue bar that served other driver

O'HARA TOWNSHIP, Pa. — The attorney for a woman whose husband was killed in a January crash tells Channel 11 he’s going after the bar that served the other driver.

Police say 29-year-old Alyssa Galiano was driving drunk and speeding with her 7-month-old in the backseat when she hit Michael and Maria Vernon on Freeport Road in O’Hara Township.

Michael, the driver, was killed. Maria was seriously injured.

Galiano is charged with homicide. Friday, Channel 11′s Gabriella Deluca questioned Galiano outside a courtroom.

She did not comment.

We did speak to the Vernon family attorney Michael DeRiso.

“We have sent out letters to Nox’s tavern of our intent to sue,” he said.

Nox’s Tavern is where Galiano was just before the crash.

“There is video of the driver sitting in the bar drinking excessively while having her baby in a car seat on top of the bar,” he said.

DeRiso contends Galiano should not have been served.

“Anybody who has a license to serve alcohol has a duty; a responsibility.”

He says the goal is to settle.

Channel 11 did reach out to Nox’s tavern about the lawsuit, but we have not heard back.

Galiano waived today’s hearing but is expected in court in January.
